- (Once in North Carolina the spelling of the name changed from Hayes to Hays) John Hays and his wife Phebe had at least six children one of whom was another John Hays (1735-1782). This John and his wife Tabitha had three children ? Nancy, Charles and Susannah. These three siblings married three BLACKMAN siblings. Nancy married John Blackman; Charles married Anne Blackman; and Susannah married Bennett Blackman. These three couples left the Sampson County, NC area as a group and migrated to Davidson County, TN about 1796.
In the court settlement of John Hays' estate dated 7 Feb 1778 in Bertie County, NC, the following individuals were identified and listed as inheritors: his wife Phebe Hays, son Hardy Hays, son John Hays, daughter Rebeckah Stephens, daughter Phebe Jernigan, daughter Mary Hays, and son Samuel Hays. Phebe received 22 pounds seven shillings and ten pence; each of the children received 18 pounds seven shillings five pence. Subsequently, a correction was made to the division of the estate. His wife still received 22 pounds seven shillings and ten pence; however, each of the children's share was raised by 10 shillings to 18 pounds seventeen shillings five pence. A copy of the settlement is available in the North Carolina archives as well as an appended account, signed by Hardy Hays, of the inventory and sale of part of John Hays' estate.

Pursuant to the dementions of an order of the Court of Please and Quarter Session begun and held for the said county on the second Tuesday in November in the year of our Lord one thousand seven hundred and twenty seven.We the subscribers have each Examined Audited and Settled the accompts of Hardy Hayse Adminstrator of John Hayse deceased and find a balance due to the said deceased estate of One Hundred and Ten pounds & one shilling and five pence proclamation money which we have divided and set apart amongst the said deceased Legal Representatives in the following manner (To wit)To Pheba Hayse wife of said deceased for her part and shair of the said deceased estate Twenty two pounds seven shillings and ten pence proclamation.
To Hardy Hayse son of the said deceased for his part and shair of said estate Eighteen pounds deven dhillings and five pence 1/2 of like money
To John Hayse son of said deceased for his part and shair of said estate Eighteen pounds seven dhillings and five pence 1/2 of like money
To Rebeckah Stephens daughter of said decd for her part and shair of said decd estate Eighteen pounds seven shillings and five pence 1/2 of like money
