    taken into the King's hand for a time. Chamberlain towards the end of this year, he being then an adherent of the Earl of Lancaster. Appointed Constable of Odiham Castlel, 1 Nov. 1317: this he had to resign next year. Appointed Keeper of the

    He was appointed a Constable of Odiham Castle, 22 Feb. 1319/20 to 21 June (or July 9) 1321. He accompanied the King to France in June 1320. Keeper of the castle, town, and barton of Bristol, 1 Oct 1320 to 10 May 1321. On 19 Augl. 1321 he was disinherited and exiled, as mentioned above, his lands being taken into the King's hand, 15 Sep. 1321. He took refuge in the Cinque Ports, and, engaging in piracy, with the King's connivance, did considerable damage. He had letters of safe
    conduct for a year, 8 Dec. 1321, and of protection, 9 Jan. 1321/2. In Mar. following he accompanied the King against the contrariants, and is said to have urged him, when at Burton-on-Trent (10 Mar.), not to prosecute war. After the battle of
    Boroughbridge, he received large grants of lands forfeited by the rebels. He was appointed Keeper of the castle, town, and barton of Bristol during the King's pleasure, 3 May 1322, and for life, 1 June 1325. Appointed Keepr of the castles,
    manors, and lands of Brecknock, Hay, Cantref Selyf, Talgarth, Blaen Llyfni, and Pencelly, co. Brecon, and Huntington, co. Hereford, 10 July 1322. He received a pardon for all his debts at the Exchequer and in the Wardrobe, 5 June 1323. In
    1324 he complained to the Pope that he was threatened by magical and secret dealings: but the Pope could only advise him to tur to God with his whole heart and to make a good confession. He was appoitned a commissioner to make peace with the Scots, 8 Nov. 1324. On 1 June 1325 he received a pardon for the acts of piracy which he had committed in 1321. He was sum. for Military Service from 30 June (1314) 7 Edw. II to 1 May (1325) 18 Edw. II, and to Parl. from 29 July (1314) 8 Edw.
    II to 10 Oct (1325) 19 Edw. II, by writes directed Hugoni le Despenser juniori, whereby he is held to have become LORD LE DESPENSER. He was taken to Hereford, tried -- without being allowed to speak in his own defence -- condemned to death as a traitor, and hanged on a gallows 50 feet high, 24 Nov. 1326. His head was set up on London Bridge, 4 Dec, and his quarters in four different places. Some years afterwards, his bones were collected, and bur. in Tewkesbury Abbey. On his death all his honors were forfeited, the sentence of "Exile" passed on him in 1321 being re-affirmed in Parl. I Edw. III.     Despenser, Hugh le, English nobleman, son of Hugh le Despenser. A supporter of the king against the barons, he fought under Edward I, for whom he secured a papal release from an oath to refrain from excessive taxation. When the barons forced Edward's son and successor, Edward II, to banish his favorite, Piers Gaveston, le Despenser supported Gaveston and in 1312 succeeded him as the royal favorite. Edward II made him earl of Winchester in 1322, and le Despenser, together with his son, Hugh, acquired vast wealth. The barons established a coalition to challenge Edward II and le Despenser, and open warfare broke out between the king and the barons. At the battle of Boroughbridge in 1322, the king's forces defeated the coalition. The elder le Despenser became virtual ruler of England, instituted several important administrative reforms, and concluded peace with Scotland in 1323. In 1326 Isabella, queen consort of England, formed an alliance with the barons against Edward and the le Despensers in favor of Edward's and Isabella's son, young Prince Edward. In a general uprising, the forces of Edward II were defeated and both father and son le Despenser were hanged.

    Sir Philip Le Despencer, Knt., of Goxhill, Lincolnshire was the son of Hugh Le Despencer, 1st Earl of Winchester and his wife, Lady Isabella Beauchamp, daughter of William de Beauchamp, 9th Earl of Warwick and Maud FitzJohn. He was born ca. 1290 in Stoke, Gloucester, England. He married Margaret de Goushill, daughter of Ralph De Gousille and his wife Hawise Fitzwarine. Philip was brother to Hugh Despenser, the Younger, a favorite of King Edward II.
    According to Douglas Richardson's Magna Carta Ancestry, Philip and Margaret were parents to Sir Philip le Despenser of Goxhill, Lincolnshire (6 Apr 1313-Aug 1349) who married Hon. Joan de Cobham, daughter of John, 2nd Baron Cobham of Kent.

    Isabel, daughter of 1st Lord (Baron) le Despenser of the 29 July 1314 creation, and had issue (bastardised by the papal annulment of 1344, [Burke's Peerage]

    Isabel le Despenser (1312? 1356) was the eldest daughter of Hugh Despenser the Younger and Eleanor de Clare. She was descended from Edward I of England through her mother, while her father is famous for being the favorite of Edward II of England.

    Though he had stood against Edward II in the past, Edmund FitzAlan, 9th Earl of Arundel had loyally supported him since the 1320s. Thus it must have seemed to be politically prudent to Edmund to marry his heir Richard to the eldest daughter of the King's closest friend and adviser Hugh le Despenser. For Hugh's part, a large incentive for him must have been that he could expect his daughter Isabel would one day become Countess of Arundel.

    On 9 February 1321 at the royal manor Havering-atte-Bower, Isabel was duly married to Richard FitzAlan, the heir to the earldom of Arundel. Isabel was only eight at the time, while Richard was fifteen (not seven as has been claimed). Their respective ages would come up later when Richard would try to seek an annulment.

    Annulment
    Richard and Isabel had one son, Edmund Fitzalan, born in 1327, and in 1331 Isabel's husband became earl of Arundel. However, in December 1344 Richard Fitzalan had their marriage annulled on the grounds that he had never freely consented to marry Isabel and that they both had renounced their vows at puberty but had been "forced by blows to cohabit, so that a son was born". Isabel retired to several manors in Essex that were given to her by her ex-husband. After receiving a papal dispensation, Richard married Isabel's first cousin Eleanor of Lancaster, with whom he had apparently been living.

    Richard and Isabel's only child, Edmund Fitzalan, was rendered illegitimate by this annulment and so was unable to inherit his father's earldom. When his father died in 1376 Edmund quarreled with his half-siblings, the children of his father's second marriage, over inheritance rights. Edmund was imprisoned in the Tower of London until he was released in 1377 by request of his brothers-in-law.

    After their father was executed for treason in 1326, Isabel and her youngest sister Elizabeth were the only daughters of Hugh the Younger to escape being confined in nunneries, Isabel because she was already married and Elizabeth because of her youth.

    John de Mowbray, 4th baron, was summoned to parliament from 14 August, 1362, to 20 January, 1366, as "John de Mowbray of Axholme." This nobleman was in the wars of France in the lifetime of his father and he eventually fell, anno 1368, in a conflict with the Turks, near Constantinople, having assumed the cross and embarked in the holy war. His lordship m. Elizabeth, dau. and heiress of John, Lord Segrave, by Margaret, Duchess of Norfolk (dau. and eventually sole heiress of Thomas Plantagenet, of Brotherton, Earl of Norfolk), whereby he acquired a great inheritance in lands, and the most splendid alliance in the kingdom. By this lady he had two sons, John and Thomas, and several daus., of whom one m. Roger, Lord de la Warre, and another m. John, Lord Welles; and a 3rd, Anne, was abbess of Barking.     ohn (III) de Mowbray, 4th Baron Mowbray (24 June 1340 ? 19 October 1368) was an English peer. He was slain near Constantinople while en route to the Holy Land.

    John de Mowbray, born 25 June 1340 at Epworth, Lincolnshire, was the son of John de Mowbray, 3rd Baron Mowbray, of Axholme, Lincolnshire, by his second wife, Joan of Lancaster, third daughter of Henry, 3rd Earl of Lancaster.

    Career
    Mowbray and twenty-six others were knighted by King Edward III of England in July 1355 while English forces were at the Downs, before sailing to France. In 1356, he served in a campaign in Brittany. He had livery of his lands on 14 November 1361; however, his inheritance was subject to the dower which his father had settled on his stepmother, Elizabeth de Vere. By 1369, his stepmother had married Sir William de Cossington, son and heir of Stephen de Cossington of Cossington in Aylesford, Kent; not long after the marriage, she and her new husband surrendered themselves to the Fleet prison for debt. According to Archer, the cause may have been Mowbray's prosecution of his stepmother for waste of his estates; he had been awarded damages against her of almost ?1000.

    In about 1343, an agreement had been made for a double marriage between, Mowbray and Audrey Montagu, the granddaughter of Thomas of Brotherton, and Mowbray's sister, Blanche de Mowbray with Audrey's brother, Edward Montagu. Neither marriage took place. Instead, about 1349, a double marriage took place between Mowbray and Elizabeth de Segrave (also granddaughter of Thomas of Brotherton), and Mowbray's sister Blanche with Elizabeth's brother, John de Segrave, Pope Clement VI having granted dispensations for the marriages at the request of Mowbray's grandfather, the Earl of Lancaster, in order to prevent 'disputes between the parents', who were neighbours. Mowbray had little financial benefit from his marriage during his lifetime as a result of the very large jointure which had been awarded to Elizabeth's mother, Margaret of Brotherton, Duchess of Norfolk, who lived until 1399. However, when Elizabeth's father, John de Segrave, 4th Baron Segrave, died on 1 April 1353, King Edward III allowed Mowbray to receive a small portion of his wife's eventual inheritance. Estate accounts for 1367 indicate that Mowbray enjoyed an annual income of almost ?800 at that time. Elizabeth then succeeded her father as 5th Baroness Segrave, her brother having predeceased their father.

    Mowbray was summoned to Parliament from 14 August 1362 to 20 January 1366. On 10 October 1367, he appointed attorneys in preparation for travel beyond the seas; these appointments were confirmed in the following year. Mowbray was slain by the Turks near Constantinople while en route to the Holy Land. A letter from the priory of 'Peyn' written in 1396 suggests that he was initially buried at the convent at Pera, opposite Constantinople; according to the letter, 'at the instance of his son Thomas', his bones had been gathered and were sent to England for burial with his ancestors.

    His will was proved at Lincoln on 17 May 1369. His wife Elizabeth predeceased him in 1368, by only a few months.

    Marriage and issue
    Mowbray married, by papal dispensation dated 25 March 1349, Elizabeth de Segrave (born 25 October 1338 at Croxton Abbey), suo jure 5th Baroness Segrave, daughter and heiress of John de Segrave, 4th Baron Segrave (d.1353), and Margaret of Brotherton, Duchess of Norfolk, daughter and heiress of Thomas of Brotherton, son of King Edward I. Through the marriage, the Mowbray family gained the estate in Framlingham, Suffolk, including Framlingham Castle, which became the main seat of power for the Mowbray family for most of the 15th century.

    They had two sons and three daughters:
    1. Margaret de Mowbray (c.1361 - 24 April 1404), who married, by licence dated 1 July 1369, Sir Reginald de Lucy (d. 9 November 1437) of Woodcroft in Luton, Bedfordshire.
    2. Joan de Mowbray (c.1363 - 30 November 1402), who married firstly Sir Thomas Grey (1359 ? 26 November or 3 December 1400) of Heaton near Norham, Northumberland, son of the chronicler, Sir Thomas Grey. They had four sons and one daughter, including John Grey, 1st Earl of Tankerville. She married secondly, Sir Thomas Tunstall of Thurland in Tunstall, Lancashire (c. 1360 ? 1415).
    3. Eleanor de Mowbray (born before 25 March 1364), who married John de Welles, 5th Baron Welles.

    d was present at the Battle of Poitiers. In recognition of his conduct in the French wars, he was summoned to Parliament as a baron in 1357. At the same time, he also became a Knight of the Garter.

    He was a friend and patron of Jean Froissart[1] and the eldest brother of Henry le Despenser, Bishop of Norwich.

    There is a statue of him on the top of the Holy Trinity Chantry Chapel in Tewkesbury Abbey, renowned as the "KNEELING KNIGHT".

    Note: In "Some corrections and additions to the Complete Peerage", www. medievalgenalogy.org.uk, it states "Mary was the daughter of Edmund, the 9th Earl of Arundel, not Richard the 10th Earl (see Arundel, vol 1, p. 244, note b)." This would also correct Burke's as well any other book that uses CP as a source.

    Following is the discussion of the evidence:

    CP Corrections, Volume 14, p.596 retains the identification of John Strange's wife Mary as a daughter of Richard, the 10th earl, but mentions Margaret Aston's argument, in Thomas Arundel, chart following p.436 (1967), that Mary was instead the daughter of Edmund, the 9th earl. It adds that if this were so, Mary would have been aged about 40 when her son John was born.

    Margaret Aston cites two records that place Mary as a sister - not a daughter - of Richard, the 10th earl: (i) in a petition to the Pope in 1364, she calls herself "Mary la Straunge, lady of Corfham, widow, and sister of the Earl of Arundell" [Cal. Papal Petitions, 1342-1419, p.484] and (ii) in Richard's will he refers to her as his sister [Reg. Sudbury, Lambeth, f.95v, cited by Aston, loc. cit.].

    A third independent piece of evidence is an agreement between the attorneys of Richard, earl of Arundel and Surrey, and the attorneys of Isabel, late the wife of John Lestrange of Blakemere, concerning Isabel's dower, which refers to this John [Mary's son] as the earl's nephew, which "agreement shall be affirmed in the king's chancery" [Cat. Ancient Deeds vol. 3, C3059: English abstract of a French original]. This agreement is undated, but was probably made soon after 28 November 1375, when an order was enrolled to the escheator in Shropshire, to take an oath from Isabel not to marry without the king's licence, and to assign her dower in the presence of Richard, earl of Arundel, or his attorneys, sending the assignment under seal to be enrolled in chancery [Cal. Close Rolls 1374-77, p.176]. A note was later added to the agreement, recording the delivery of dower by the assent of Richard, now earl of Arundel, and the other executors of Richard, the former earl [who had died in January, 1375/6]. This was perhaps in June 1376, when following Isabel's unlicenced remarriage it was ordered that she should have her dower with the "assent of Richard now earl of Arundell and other the executors of Richard late earl of Arundell" [Cal. Close Rolls 1374-77, p.378].

    As to the chronology, Mary's son John Lestrange was born in the early 1350s [Complete Peerage volume 12, part 1, p. 344], while Edmund, the 9th earl of Arundel, married while a minor in 1305 and was executed in 1326. From this it appears that Mary could have been under 30 when John was born. (However, Mary's daughter Ankaret, the eventual heir, was born later, about 1361 [p.345].)

    Notes:

    Sir Edmund Arundel, knt (c. 1327 ? 1376? 1382), the only child of the marriage between Richard FitzAlan and Isabel le Despenser, was bastardized by the annulment of his parents' marriage. He thereafter was known by the name of Arundel.

    He married at the age of twenty, in the summer of 1347, Sybil Montacute or Montague, a younger daughter of William Montacute, 1st Earl of Salisbury and Catherine Grandison, whose elder sister Elizabeth was married to his mother's brother.

    Because he has been declared illegitimate after the annulment of his parents' marriage, after his father died the estates that should have gone to Edmund went to his younger half-brother Richard, then about 29. "Sometime before the end of 1376, Edmund and at least fourteen of his supporters attacked the six manors of Essex which his father had granted to his late mother Isabella for her sustenance in 1344/4 after the annulment of their marriage . . . They broke into houses, fished in Earl Richard's fishery, stole ?100, and assaulted and imprisoned Richard's servants." When the incidents came to the attention of the authorities, Edmund with his cousin Henry Despenser as his lawyer appeared before the king and "agreed to settle the 'quarrel, dissensions, strife and controversy' between them. Edmund appeared again before the king and his council on 16 February 1377 and was imprisoned in the Tower of London, though was released on 5 June that year. . . ."

    "Little is known of Edmund Arundel after late 1377. In July 1379, he and his son-in-law Sir Richard Sergeaux of Cornwall borrowed ?500 from Matthew Gurney . . . By 1390, Sergeaux had still not paid Gurney Back.

    "Edmund Arundel was still active in February 1381, now in his mid-fifties, and appointed attorneys to act for him when he went to Gascony on a military expedition. He was dead by February 1382, when his two surviving daughters, Elizabeth Meriet (formerly Carew) and Philippa Sergeaux, and Robert Deincourt, his grandson from his other daughter Katherine, were involved in a legal case."
