    Thomas of Aldithley or Audley, son and heir, b. 1288, was aged over 10 at his father's death. He m. Eve, daughter and heir of John of Clavering (2nd Lord Clavering), by Hawise, daughter of Robert de Tibetot. He dsp while still a minor, shortly before 21 Nov 1307. Writ for Inq.p.m. 16 Jan 1307/8. His widow m. 2ndly, bef. 2 Dec 1308, Sir Thomas de Ufford, who was slain at Bannockburn, 24 June 1314. After his death, she lived with, but did not marry, (possibly owing to some difficulty in obtaining a dispensation; or to avoid the fine which she would have had to pay on marriage) Sir James Audley (who d. 1333/4) 1st cousin of her 1st husband.     BARONY of AUDLEY (I)

    NICHOLAS AUDLEY or ALDITHLEY, of Heleigh, co. Stafford, brother and heir to Thomas, born 11 November 1289. He had seizin of his brother's lands, having proved his age 27 March 1313/4. He was summoned to Parliament by writs directed Nicholao de Audele, 8 January (1312/3) to 25 August (1318) whereby he may be held to have become LORD AUDLEY. He married in 1312, without license, Joan, widow of Henry, EARL OF LINCOLN, the only child that had issue of William MARTIN [LORD MARTIN], by Eleanor, widow of John DE MOHUN, of Dunster, daughter of Sir Reynold FITZ PIERS. He died in 1316, shortly before 6 December, aged 27. His widow died between February 1319/20 and 1 Aug. 1322. [Complete Peerage I:339, (transcribed by Dave Utzinger)]

    BARONY OF AUDLEY (II)

    JAMES (AUDLEY or ALDITHLEY), 2nd LORD AUDLEY, son and heir, born 8 January 1312/3, at Knesale, co. Notts, and baptised there; aged 3 at his father's death, and 14 in 1326, at the death of his maternal uncle, William Martin, to whose vast estates in counties Pembroke and Devon he was coheir, and eventually (by the death, in 1343, of his mothcr's sister, Eleanor, widow of Philip, Lord Columbers) sole heir, and would then apparently have been entitled to any Peerage which his aforesaid uncle may be held to have possessed. He had selzin, though not of age, 25 May 1329. Though still a minor, 21 March 1333/4, he was summoned to Parliament. as early as 25 Jan 1329/30 to 8 Aug 1386. An order for his arrest issued on 28 July 1348 because he had not attended the King and Council when summoned. He had exemption for life from attending Parliament 20 April 1353.

    He married, 1stly, before 13 June 1330, Joan, daughter of Roger (MORTIMER), 1st EARL of MARCH, by Joan, 1st daughter and heir of Sir Piers de Geneville (2nd but 1st surviving son and heir apparent of Geoffrey, 1st Lord Geneville), which Earl had been his guardian. She died between 1337 and 1351. He married, 2ndly, before Dec 1351, Isabel (c), said to have been daughter of Roger (Le STRANGE) 5th LORD STRANGE OF KNOKYN. She was living in 1366. He died I April 1386, at Heleigh, and was buried at Hulton Abbey, aged 73. Will, in which he styles himself "Lord of Rouge Chastel [i.e. Red Castle, Salop] and of Heleigh," dated 1385.     (c) In a pedigree of Touchet, dated 1597, apparently prepared for George, 1st Earl of Castlehaven (Ireland) (who d. 1617), this Isabel is said to have been daughter of Robert, Lord Fitzwalter. See "Genealogist", N.S. vol xxxvi, p. 15. Roger, 5th Lord Strange (of Knockyn), was not b. till circa 1326 and m. as a child, in or bef. 1338. See that title.

    BARONY of AUDLEY (III)

    NICHOLAS (AUDLEY or ALDITHLEY), 3rd LORD AUDLEY [and, as some may consider, LORD MARTIN], son and heir by 1st wife, born about 1328. He was knighted before 1352, and in 1352 was in arms, with his next brother Roger, against their father, when they sacked Castle Heleigh. He was in the wars with France (v.p.), 1359 and 1372, arid was afterwards Chief Justice of South Wales, 1 February 1381/2. He was summoned to Parliament 17 December 1387 to 12 December 1390.

    He married (settlment (1329/30-1330/1) 5 Edward III, both being then under 12) Elizabeth, daughter of Henry (BEAUMONT)) LORD BEAUMONT, by Alice, suojure COUNTESS OF BUCHAN [Scotland]. He died s.p., 22 July 1391, (Writ for Inq. p. m. 30 July 1391) when the BARONY OF AUDLEY, 'together, apparently, with the BARONY OF MARTIN, fell (in accordance with modern doctrine) into abeyance between his sisters or their descendants (c). Will dated and probated the year of his death. His widow died 27 October 1400. Her will, in which she directs to be bur. in Hulton Abbey, with "my very honourable husband Lord D'Audeley," dated 30 September and proved 2 November of the same year.     (c) These were (1) John Tuchet, his great nephew, by Joan his sister of the whole blood. (2) Margery, his other sister of the whole blood, then aged 40, and the wife, in or bef. 1353, of Sir Roger Hillary, but who dsp in 1410/1, and (3) "Fulk, son of Fulk Fitz-Warin, son of (another) Margery, half sister of the said Nicholas." Thomas, Rowland, and James Audley, brothers of the whole blood of the last named Margery, all dsp in their half-brother's life time. In Close Roll, 31 Edward III, m. 17 d, mention is made of Katharine, daughter of Sir James Audley of Rouge Castel and Heleye, wife of Thomas Spigurnel. She therefore must have been another sister or half sister of Nicholas, Lord Audley, but must have dvf and sp.

    Complete Peerage II:3-6 note (f) indicates that Isabel may have been illegitimate, a half-sister, or a full sister. In any case her brother Ralph the 3rd Lord Basset (who dsp), left the bulk of his estate to Isabel's son, Hugh; thus Isabel was the major heir, and was probably legitimate.

    BARONY of BASSET (of Drayton) (III)

    RALPH (BASSET), LORD BASSET OF DRAYTON, grandson and heir, aged 8 in 1343, being son and heir of Ralph Basset, by Alice, daughter of Nicholas AUDLEY [LORD AUDLEY], of Heleigh, co. Stafford which last Ralph was son and heir apparent of the last Lord, and died v.p. about 1335. He had livery of his father's lands 6 June 1355. He joined the army of the Black Prince, and was at Bordeaux 8 January 1355/6. He was summoned to Parliament from 26 December 1357 to 6 December 1389 and greatly distinguished himself in the various wars with France. K.G., 1368. On 30 October 1386, at the age of 51 he was a deponent in the Scrope and Grosvenor controversy.

    He married 1stly about May 1338, Joan, daughter of Thomas BEAUCHAMP), EARL OF WARWICK, by Catherine daughter of Roger (MORTIMER), EARL OF MARCH. She died s.p. He married, 2ndly, Joan (sister of John, DUKE OF BRITTANY and COUNT OF MONTFORT in France, EARL OF RICHMOND in England), daughter of Jean DE BRETAGNE, COUNT OF MONTFORT, by Jeanne, daughter of LOUIS DE FLANDRE, COUNT OF NEVERS. He died s.p., 10 May 1390. He was buried under a " goodly monument in Lichfield Cathedral, " when the Barony became dormant,. or, possibly fell into abeyance between the heirs of his two great aunts (f). His widow obtained a grant, 23 April 1398, of the Honour of Richmond (formerly belonging to her brother) which, however was resumed by Henry IV. She died 8 November 1402, and was buried in the Abbey of Lavendon, near Olney, Bucks. [Complete Peerage II:3-6, (transcribed by Dave Utzinger)]

    (f) The heirship of the last Lord is somewhat doubtful. As to many of the estates the heir was found to be, according to one inq., Thomas, Earl of Stafford, son of Hugh, son of Ralph, son of Margaret Basset, sister to the grandfather of the deceased; but, according to another inq., the heirs were (1) the said Earl of Stafford and (2) Alice, wife of William Chaworth, descended from Maud, a sister of the said Margaret, who m. Sir William Herriz. These findings were confirmed by another inq. (1403), on the death of Joan, widow of the last Lord Basset. It is certain that the last Lord devised all his estates to his nephew ("mon neveu"), Hugh Shirley, and the heirs male of his body, with remainder to William Stafford (brother of the Earl of Stafford), and to divers others. It is certain, also, that the Shirley family inherited, by this devise, considerable estates in the counties of Nottingham, Leicester, and Warwick (touching which Sir Ralph Shirley had a memorable dispute with the Earl of Stafford), many of which remained in the Shirley family till the death of Earl Ferrers in 1827. Isabel, the mother of Hugh Shirley, appears to have been sister of the last Lord Basset--possibly of the half blood--which, even were she his paternal sister, would at that time have precluded heirship; but inasmuch as Alice, mother of the last Lord, m. Hugh de Meinill, she might, not improbably, have been a bastard sister, and "the last Francis Townshend, Esq, Windsor Herald (1784-1819), on the authority of Robert Glover, Somerset, a most learned and skilful herald, considered the illegitimacy of Isabel Shirley to be indisputable; quoting a lineal descendant and heir, in which she is called natural sister of the last Baron, and the coat assigned to her is debruised by a baton. If the illegitimacy of Isabel be established, this dignity (the Barony of Basset) would be in abeyance between the representatives of Thomas, Earl of Stafford (who is presumed to be the present Baron Stafford), and those of the said Dame Alice Chaworth, who (upon the decease of her great-granddaughter and heir), in 1507, were (1) Joan, wife of Sir Thomas Dynham; (2) Elizabeth, wife of Anthony Babington; and (3) Anne, wife of William Mering, who dsp.

    A tabular pedigree of the coheirs of this Barony (on the supposition that Isabel Shirley was a bastard) is in Coll. Top. et Gen., vol vii, p. 257, while at p. 392 of the same volume, are given the arguments in favour of her legitimacy; which are also urged (with, perhaps still greater force) by Sir Egerton Brydges in Collins, vol iv, p. 91.

    Courthope adds this note, which shows a belief (right or wrong) in the Shirley family that the Barony of Basset had vested in them: "It may here be remarked as an instance of unaccountable negligence or ignorance, that in the Patent creating George Townshend, Lord Ferrers of Chartley and Lord Compton (heir general of the above Sir Thomas Shirley and Isabel Basset) to be Earl of Leicester in 1784, he is called Baron de Ferrers of Chartley, Baron Bourchier, Lovaine, Basset, and Compton. In 1784 it is unquestionable that the Baronies of Ferrers of Chartley and Compton were vested, jure matris, in the Hon. George Townshend, but it is confidently alleged that he was not legally possessed either of the Baronies of Bourchier, Lovaine, or Basset. As it would scarcely be imagined that titles of honour should be lightly attributed in a patent under the Great Seal, this assertion requires to be supported by facts, and the following brief account of each of the Baronies in question may be deemed satisfactory. . . ."

    Note: The patent to George Townshend in 1784 recognizes Isabel as a legitimate heir and sister of Ralph Basset, 3rd/Last Baron of Drayton.
